Daily, Nicholas S., 57, partner with Depew, Gillen, Rathbun and McInteer, died Monday, December 11, 2006. Service 2:00 P.M., Thursday, December 14, East Heights United Methodist Church. Nicholas attended Duke University in Durham, NC, 1967 - 1969 and the University of Kansas, Lawrence, KS, 1974 - 1976, receiving his B.A. in History. He received a J.D. degree from the University of Kansas Law School in December, 1978. Nicholas was a Research Assistant to Honorable Senator Robert Dole, August 1970 - 1971. He received an honorable discharge for the U.S. Army, serving May 1971 - June 1974. He was a trial attorney with Foulston Siefkin, Wichita, December 1978 - April 1991. His emphasis was on personal injury defense work. Nicholas worked as a trial attorney at Depew Gillen Rathbun McInteer, L.C., Wichita, April 1991 to present, where his emphasis was on business, personal injury and medical malpractice litigation. Nicholas held memberships with the Aviation Museum Board, the American Bar Association and the Kansas Bar Association. He was a Fellow with the Kansas Bar Foundation, served on the Kansas Bar Association Bench and Bar Committee, 1993 - 2005 and as Chairman, 1995 - 1998, the Kansas Bar Association Ethics Advisory Committee, 1989 - 1993 and 1998 - 2005. He served on the Kansas Bar Association Ethics Grievance Committee in 2005 and the Kansas Association of Defense Counsel, Board of Directors, 1990 to present, Secretary-Treasurer, 1992 - 1994 and as President in 1996. .Survivors: children, Jeff Daily of Bay St. Louis, MS, Cameron Daily of Tempe AR, Haleigh Daily, Laiken Daily and Grant Daily, all of Wichita. To the Family of Nicholas Daily, We were very fortunate to have made a connection in this lifetime with Nick. In our time of need, Nick was there to guide us through our company’s first lawsuit in over sixty years. Recently, he was helping us deal with our insurance company from damage caused by a torando. This is insignificant to you, we know, but that is how we first became acquainted with Nick. Over the years, he has always been kind and willing to listen. He made you feel that your concerns were his concerns, even when he had larger, more pressing matters to deal with. Recently, he visited our home one day in late August, and lunched with us in route to another meeting. We loved his combined personal and professional manner. Reading his obituary explained his many accomplishments, and also explained more of his personality–he never talked himself up, or acted pompous. He had the ability to evaluate a situation quickly, and follow-up with brief, accurate conclusions in any form of communication. He was a pleasure to be around, most of all. We considered him a friend, not just our lawyer. Since learning about his passing Monday, we have thought about him often with regret and sadness. We wish we could have known him longer–in work and in play. Anyway, whoever is reading this, please know that we send our sympathy to the family, especially at this time of year where family and friends are so important. Nicholas was a very honorable man. I was a classmate of his son Jeff at Booth Elementary School in Wichita, I would like to relay my condolences to the family on the passing of his Father.
Nick was not only my attorney, he was my friend. He won a long and difficult case for me. I will miss our chit chats on the phone.
